3. Presentations

Action: A. Great Wicomico Water Hazard - Old Great Wicomico Light

Mr. Ben Ames, President of an Anglers Club based here in the Northern Neck, presented the concern of a rock pile in the Great Wicomico that was left when the lighthouse was pulled out of the river in 2015. He explained that the rocks were placed and left there by the Coast Guard, and since then, a number of boaters have run into that pile. Mr. Ames introduced Mr. Wayne Young, a former Coast Guard officer, who was present virtually to provide a report on the rockpile for the Board.

Mr. Young attended the meeting via zoom and summarized his findings related to the rockpile. Mr. Young’s presentation and a summary of his findings can be found in board docs. Supervisor Williams asked Mr. Young if the fixed warning marker is more appropriate than a buoy type marker.

Mr. Young stated absolutely because buoys move around, and a fixed marker would clearly define the location of the pile.

Supervisor Williams asked if one fixed marker would be sufficient.

Mr. Young stated that he’d prefer several around it, however having one fixed marker would be a good start.

Supervisor Fisher asked if a lighted marker would interfere with the regular navigation markers going in and out of the river.

Mr. Young explained that it wouldn’t interfere if it was appropriately designed. The Coast Guard could advise how that should be done to not interfere with the other navigation markers. Chairman Haynie asked if there were representatives from the Coast Guard present at the meeting.

Page 3

LCDR Justin Strassfield and Mr. Dana Wise were present on behalf of the Coast Guard. LCDR Strassfield explained that he was able to gather a brief history of the rockpile when it was brought to his attention a few days ago. He stated that the Coast Guard removed some of the obstructions in 2014 and converted the buoy that was in the area making the obstruction by 2018. There was a history of it walking off station which is the inherent risk of having a floating aid there, so in 2018 they decided to convert to a lateral aid. He informed the Board that they were in touch with NOAA Office of Coast Survey before yesterday and they’re looking at doing a survey before Memorial Day. Furthermore, there was supposed to be a chart update published today that enhanced the symbology there to show the additional obstructions in the area. LCDR Strassfield stated he’s looking forward to seeing the results of the survey and if there were remnants left over by the contractor in 2014, they’d be interested in looking at some kind of enhancement or remediation.

Vice Chairman Brann stated his knowledge of several vessels hitting that rockpile and nothing being done about it although it’s a life safety issue. He believes the Coast Guard needs to take a step in the right direction and mark it or have it removed, but having one marker and relying on the boaters to know all the rules and regulations is not going to work.

Several stories were shared by experienced watermen who have run into the rockpile over the years.

Vice Chairman Brann suggested the formation of a work group to help take care of this matter. He stated that he believes Mr. Fisher and Mr. Williams would be ideal representatives from the Board, and a member of the Coast Guard should be involved as well. Additionally, there were many citizens in the public who were interested in being involved with the work group.

Motion to create a working group/committee to address the concerns of the icebreaker rockpile hazard in Great Wicomico River.

Motion by: James W. Brann, second by: James M. Long.

They are also working with Mrs. Booth’s records to provide accurate figures to the Board.

Aye: James M. Long, Richard F. Haynie, James W. Brann, Chip Williams, AC Fisher, Jr. Chairman Haynie asked Mr. Thomas his reasoning for applying for the grant.

Commissioner of Revenue Todd Thomas explained that all neighboring localities applied for this grant last year, but they didn’t receive a great amount of funds. However, this year the General Assembly reached out to notify the localities that they doubled the amount, so he decided to apply last minute with no clue the County would get awarded this amount. Mr. Thomas explained that the funds have to be used for recreational purposes, and he thought of a few areas in the County that the Board had discussed.

County Administrator Tadlock stated that last year’s grant funds received were used to help clear the property at Hampton Hall.

Chief Balderson stated that when he previously brought the Lifepak 35 purchase request to the Board in December, he mentioned that he applied for a rescue squad assistant fund (RSAF) grant, but he didn’t think the County was going to receive it. Mr. Balderson informed the Board that the County actually did receive those grant funds and one of the pieces of equipment included in that grant is the Lucas CPR device. Chief Balderson explained that the RSAF grant requires a 50/50 match, and he reached back out to Striker to get an updated quote as they

Page 10

anticipated a price increase. The original quote was for $19,066.26 with a county match of $9,533.13. The updated quote provided was $19,732.77, which is roughly a $600 increase. Chief Balderson asked the Board for permission to move forward with this grant as well as permission to utilize EMS Billing monies to purchase this device and then submit for reimbursement. He also explained to the Board that he applied for the grant prior to the price increase, so unfortunately the grant amount is for the original quote and the County will have to pay for the $666.51 difference.

Motion to allow Chief Balderson to purchase the Lucas 3 CPR device in the amount of $19,732.77, utilizing the RSAF grant and EMS Billing monies. The total EMS Billing monies to be used is $10,199.64.

Emergency Services - Rescue Squad Assistance Fund (RSAF) Chief Balderson stated that they have a stretcher that is too old to be included in their ProCare contract with Striker which is a service agreement that allows them to service the equipment to make sure it’s appropriate, ready to be used, and meets their specifications. Mr. Balderson explained that he’d like to apply for the now open RSAF grant in order to replace the outdated stretcher. He informed the Board that the cost of the stretcher is $35,528.00, and if the Board grants him permission to move forward with the grant, it will ultimately cost the County $17,764 after the grant reimbursement is received.

Motion to allow Chief Balderson to apply for the RSAF 50/50 reimbursement grant.

County Administrator Tadlock explained to the Board that the County has started to run into issues with the gas pump over the last several years. After speaking with the Sheriff, it is believed that the pump was installed in the mid-90s. Provided in the Board’s packet were two estimates from NWP and JF Petroleum, along with items related to the electrical work for trenching versus direct boring, however staff reached out to JF Petroleum to get updated quotes

Page 11

and that information was not received and they also did not provide an estimate for the dual wall fuel tank. Additionally, County Attorney Gregory informed Mr. Tadlock that this could be pulled under emergency procurement because emergency vehicles have not been able to access the fuel pump, and only one updated bid was received.

Vice Chairman Brann asked if there was a better location for the fuel pump in the instance the County decides to do something with that property. He asked if it would benefit Sheriff Beauchamp more if the pump were closer to his office building.

Sheriff Beauchamp stated that’s a good point, but he’s not the only one who accesses the pump. Mr. Beauchamp explained that County Admin, Building & Zoning, EMS, and Social Services all access the pump, but it may be in their best interest to move the pump because that gate opens and closes every time someone gets fuel.

Vice Chairman Brann suggested that they postpone the matter until next month after staff discusses other possible locations for the pump.

Motion to table a decision to next month's meeting after further discussion on the location of the pump.

Motion by: James W. Brann, second by: Chip Williams.

Final Resolution: Motion Carried

Aye: James M. Long, Richard F. Haynie, James W. Brann, Chip Williams, AC Fisher, Jr. Information: T. Corrective Action Plan

County Administrator Tadlock stated that the corrective action plans for the County, Treasurer, and the Schools are available in board docs for the Board’s review.

Supervisor Williams asked when that information was sent out to the departments and when the corrective action plans were received.

County Administrator Tadlock explained that information was sent out soon after the board meeting and the School’s plan was received yesterday. He was unable to locate all the email threads at this time but assured the Board that he’d provide the emails of when the information was requested and when the plans were received.

The Board agreed that they weren’t comfortable moving forward with the School’s corrective action plan since it was just received yesterday.

Page 12

The Board agreed to carry this matter over to next month, so they have more time to review the plans.

County Administrator Tadlock stated that the County currently had cooperative procurement with Southern Air, and they provided a quote to bypass the boiler system at the Extension Office and install the HVAC system. The total cost provided was $28,730.24.

Chairman Haynie shared his dissatisfaction with the price and offered to speak with Southern Air directly to receive a lower quote. If not, he suggested the County seek other bids. County Administrator asked Chairman Haynie to let him know when he’d like to meet with Southern Air, and he’d coordinate that for him.

Page 13

Information: Y. Other County Administration Items

County Administrator Tadlock provided an update to the Board in relation to the Convenience Center Tags. He stated that he met with the Treasurer and the Commissioner of Revenue about the database related to the tags and the Commissioner had requested tag samples and pricing from BMS and American Solutions. Mr. Tadlock explained that right now there are approximately 9,800 homes, meaning 10,000 tags times two (2) tags minimum per household, totaling 20,000 tags. He informed the Board that they are still working on receiving this information, so this will be provided to the Board as soon as possible.

Supervisor Fisher asked if the County was looking at getting tags or stickers. Mr. Tadlock stated that staff is requesting quotes for both options.

Additionally, the Board requested that the Building Official evaluate the old School Board office in Lottsburg and the old Sheriff’s Office building in Heathsville. Provided in the Board’s packet is a summary of his findings.

The Board asked that Mr. Jerry Rushing, Building Official, be present at next month’s meeting for further discussion on his findings.

County Administrator Tadlock also provided the Board with draft ordinance language in relation to the use of rifles for nuisance.

Supervisor Fisher shared his concern for allowing people to shoot high power rifles at nighttime from ground level.

The Board agreed to table a decision after further discussion.

Action, Information: Z. Rescind Ordinance - Chapter 68; Fee Schedule

Motion by: James M. Long, second by: James W. Brann.

Final Resolution: Motion Carried

Aye: James M. Long, Richard F. Haynie, James W. Brann, Chip Williams, AC Fisher, Jr. Information: B. Board Comments

Supervisor Fisher suggested that the Assistant Superintendent be present at the Board of Supervisors meetings when the Superintendent is unable to attend.

Supervisor Fisher then asked what the procedure is on unpermitted cargo containers. Zoning Administrator Philip Marston stated that it’s a violation, and they would need to apply for a conditional use permit if the property is zoned agricultural.

Page 15

Supervisor Fisher asked if the County is going to require that the permitted ones already in use be painted.

County Administrator Tadlock stated that the Board could place a condition on future permit applications that come before them in relation to painting the container.

Supervisor Fisher then asked if the containers in place before the zoning ordinance was adopted could be removed.

Zoning Administrator Marston stated that the containers there prior to the ordinance adoption would be grandfathered in and do not need a permit.

Vice Chairman Brann asked Mr. Tadlock if a Social Services representative could be present at the meeting next month to present a few items in relation to the following questions:

1. Does DSS offer any programs or assistance that encourage individuals to get off benefits and encourage them to get out in the workforce? (encouraging them to not require as many benefits or any benefits at all)

2. Based on their report, 23.6% of citizens are on Medicare. The Board would like a breakdown of the age groups.

3. What is the process for who receives fuel and crisis fuel funds?

Vice Chairman Brann stated that Hampton Hall looks good cleaned up and he’d like to see Hatches Avenue evaluated as well. He stated that it used to be a nice public boat landing and if it’s not salvageable, it’s probably another piece of County property that they can look into selling.

Supervisor Long asked County Attorney Gregory if he’s had a chance to meet with the school’s attorney on the old EVB building property transfer.

Mr. Gregory stated that he communicated with the school’s attorney via email and over the phone, and he was made aware that the attorney had not received guidance on that matter from the School Board. Both attorneys recommend that staff or representatives from both Boards meet to discuss a resolution.

Supervisor Long also requested that the County property evaluation documentation be gathered for discussion at next month's meeting.

Supervisor Williams shared his disappointment with the School Board and the Superintendent for choosing not to participate in the Joint Finance Committee meetings. He also disagreed with the

Page 16

fact that they sent two representatives from the school tonight that are unable to answer any of their questions. Mr. Williams believes another representative should be present tonight, likely the Assistant Superintendent. Supervisor Williams stated that all these meetings they are missing go a long way towards the County’s budgeting process and when they’re here the Board is able address the concerns they encounter. Later, the school will say the Board hasn’t adopted a budget yet and they can’t issue their teachers’ contracts. He stated that the school needs to attend the meetings so they can get some items sorted out.

The Board referenced the recent School Board meeting and how the School Board voted to not attend the Joint Finance Committee meetings anymore. Chairman Haynie asked Mr. Tadlock to read the letter from the Superintendent and the School Board in relation to future meetings. Vice Chairman Brann stated that he’s been asked to suggest that the public have the ability to vote whether or not the School Board be elected versus appointed. He believes that this should be placed on the ballot in November for the citizens to vote on and decide.

County Attorney Gregory stated that he could research this process and bring the information back to the Board.

County Administrator Tadlock read his letter to the Superintendent inviting her and the School Board to the upcoming Joint Finance Committee meeting:

“Good Morning, Happy New Year! This is just a reminder of the Joint Finance Committee meeting to be held on January 7, 2025 at 5:30 p.m. in the General District Courtroom. Please find the attached information that was previously sent out with the updated agenda, reflecting the change in meeting dates. Sincerely, Luttrell.” – Sent January 3, 2025

County Administrator Tadlock then read Superintendent Wargo’s response:

“Hello Mr. Tadlock, Happy New Year! I hope you and your family enjoyed the holidays. The School Board declines the invitation for the Joint Finance Committee meetings 2024-2025 including January 7, 2025. As stated previously, the Joint Finance Committee meetings were unproductive, the meetings led to misinformation, and a very late budget adoption. I am corresponding on behalf of the School Board, per this email the School Board will not be in attendance on January 7, 2025. Please reach out if you have any questions.” – Received January 4, 2025

Chairman Haynie stated that their last meeting was February 5, 2025 and it was a very productive meeting even though there was no School Board representative engaging in the

Page 17

meeting. However, he explained that Dr. Curran was present. The next meeting is scheduled for March 5, 2025 and they will be working on the budget.

Supervisor Long suggested having a Joint School Board and Board of Supervisors meeting. Supervisor Williams made the Board aware that Docks of the Bay is going to remove the final vessel in the little Wicomico beginning February 24, 2025, weather permitting. E911 Communications Supervisor Jennifer Packett presented her concerns with the GeoComm mapping system software the County implemented in November 2023. Mrs. Packett explained that she emailed her concerns to several staff members beginning in February 2024 regarding the system not being user friendly in a 911 emergency role. She shared scenarios where the system did not operate properly and how it could have affected emergent outcomes. Mrs. Packett stated that they need to find a solution and she believes this is urgent, so they are able to find where people are in emergency situations.

Vice Chairman Brann stated that he’s requesting an in person meeting with someone from the company so they can listen and see what the system is not doing properly.

Chairman Haynie asked when the software was last updated.

Mr. Tadlock stated that he’d have to look back at the contract that was brought to the Board. Chairman Haynie asked Mr. Tadlock to gather this information for the Board.

**Chairman Haynie requested a 10-minute recess.

7. Public Comments (4 MINUTE TIME LIMIT)

Mrs. Suzanne Smart shared her concerns related to abuses occurring at the Northern Neck Regional Jail. She referenced the Chairman’s comments regarding the well-run jail operation and how they pass all audits, inspections, where they relate to food service preparation, and how they treat and handle the inmate population. She believes there is a disconnect between the many first-hand accounts of alleged atrocities being committed and those who run and manage the jail. She encouraged the Board to attend one of the Regional Jail board meetings. Mr. Maurice Johnson stated that Supervisor Fisher attended yesterday’s meeting and explained that he’s only hearing one side of the story. Mr. Johnson stated there’s a reason for that. There was a group of detainees that were in the jail and then they were able to voice what was going on inside. Mr. Johnson believes that the issues need to be addressed, and the Board needs to show

up to the board meetings. He also suggested that Northumberland should become unassociated with the jail.

Mrs. Johnson referenced letters she’d received from those in the jail who spoke about their living conditions.

Dr. Karen Leslie attended the meeting virtually and introduced herself as the Assistant Superintendent of Northumberland County Public Schools. She wanted to make the Board aware that she had been attending their meetings virtually. She thanked the Board for their invitation and stated that she did intend to be present at the meeting tonight, but she was told that there were other representatives being sent in her stead. Dr. Leslie explained that she’d love to attend the meetings and work with the Board with anything moving forward.

Public Hearing Closed.

Vice Chairman Brann asked why this matter had to come before the Board.

Zoning Administrator Marston explained that when the request originally came to the Board of Supervisors for the construction of an assembly hall, the Board put a condition on that approval that their signage be limited to 32 sqft.

Vice Chairman Brann asked for clarification since the original permit was for a different owner. County Attorney Gregory explained that the conditions run with the land.

Zoning Administrator Marston read the suggested conditions if approved.

Suggested Condition if Approved:

1. Modifying condition #4 “All off-street signage is limited to 32 square feet” to: “Any proposed signage shall comply with the sign regulations in the Northumberland County Zoning Ordinance.”

2. The remaining, previously approved conditions on September 12, 1996 shall remain as approved.
