Superintendent Leslie provided an update on behalf of the school division. The full presentation can be accessed in the attachments. Dr. Leslie explained that highlights for each school can be found in their Board Docs.

Chairman Brann asked if she has received the drawings of the playground yet. Dr. Leslie stated she has not and expects it to take a couple weeks.

Supervisor Long asked about summer school.

Dr. Leslie explained that they do not offer summer school anymore as it is not included in their budget, however they do offer an extended school year for those with learning disabilities and credit recovery.

Finance Facilitator Karen Pica provided a finance update to the Board. She informed the Board that they are finally current on the electric bill, are continuing to book revenue, and 90% of the chart of accounts changes are complete to be consistent with state accounts for reporting. Dr. Pica reminded the Board of the importance of taking a look at the nutrition funds in June before any additional funds are appropriated in July because it's clear that the County is spending more than they are receiving in revenue. Lastly, Dr. Pica explained that her original intent was to balance all account lines in the chart of accounts and she has found out she is unable to do so. Instead, she is focused on making sure that they are balanced in each school in each category. Dr. Pica's executive summary can be accessed in the attachments.

Vice Chairman Williams asked if the nutrition fund has been exhausted at this point.

Dr. Pica stated no, there's a carry over amount, but according to the state report the expenditures exceed the revenue.

Page 3

Dr. Pica informed the Board that she did send over the additional information regarding the appropriation option twice a year with controls for the Board to consider at any point.

In addition, Dr. Pica requested that the Board consider two transfers as presented below. The first transfer is for refunds and the second transfer are for items that were not included in the original budget or expenses that were incurred and not anticipated.

EMS Chief Bailey explained that he has been working with the Sheriff's Office to implement computer-aided dispatch (CAD) with Central Square which is the Sheriff's office CAD vendor. Mr. Bailey stated that no additional appropriation is needed as this is already in their current operating budget.

Motion to approve the request and authorize Emergency Services to enter into a contract with Central Square related to computer-aided dispatch.

H. Emergency Services Vehicle Request

Board Presentation.pdf

EMS Chief Bailey provided the Board with three quotes related to his vehicle request and explained that this vehicle purchase was approved in the FY26-30 capital improvement plan. The full presentation can be accessed in the attachments.

Supervisor Harris wondered why all the quotes provided were for Ford vehicles when there are other major brands available.

Chief Bailey explained that most of the fleet is Ford.

Chairman Brann believes they've been trying to stay consistent rather than dealing with multiple dealerships. He stated that in his experience, the local dealerships cannot compete with the prices.

Page 7

Chairman Brann asked what the balance will be in the EMS billing recovery fund with this amount taken out of it.

Chief Bailey stated as of April 14, 2026 the balance was $696,318. Roughly $20,000 was brought in from April 1st through April 30th, so the balance is sitting roughly around $715,000 once the Treasurer's Office deposits the $20,000.

Motion to approve the purchase of a vehicle for the Assistant Chief (ES-2) in the amount of 75,705.30 utilizing EMS billing monies and with cooperative

procurement through Bradford County Sheriff's Office.

I. Other County Administration Items

County Administrator Tadlock explained that the Board requested information related to rising the hazardous duty multiplier from 1.7% to 1.85%, bringing the VRS rate from 15.03% to 15.96%. This rate has been built into the proposed budget for fiscal year 2027 with an impact of about $60,000. If the Board wishes to move forward with this, a resolution has to be completed and adopted a month prior to implementation.

Supervisor Long made a motion to move forward with the request.

Supervisor Harris suggested diving into the budget a little more before making a decision. He asked if this needs to be completed tonight.

Mr. Tadlock stated that it would need to be completed at the June meeting in order to be implemented by July 1, 2026.

Supervisor Long rescinded his motion.

5. Committee Reports

Chairman Brann attended the ribbon cutting at the Library on Saturday for the pocket park. He stated that everyone needs to take the time to go visit as it's a beautiful place to sit and relax while reading a book.

Supervisor Long asked if there were any current burning restrictions.

Mr. Tadlock stated that the County does not have a current burn ban in place. Chief Bailey stated that the Commonwealth has a statewide burn ban for no burning until after 4:00 p.m., but that ended on April 30, 2026.

Mr. Tadlock explained that the County has issued burn bans in prior years but that is when they've experienced extremely dry conditions and had long periods of no rain.

8. Public Hearings 7:00 P.M.

A. TABLED FROM THE APRIL 9, 2026 BOARD OF SUPERVISORS MEETING; Request by Darryl & Joyce Krolicki, owners, for an Exception to the Chesapeake Bay Preservation Area Ordinance in order to construct an addition to a dwelling on property zoned R-2, Residential Waterfront. The property is shown as Tax Map Parcel # 44-C(1)-22 and is located at 84 Crane Court.

Krolicki.pdf Kroliicki Revision.pdf Revised Suggested ConditionsBOS 05-14- 2026(2).doc

Mr. Krolicki explained the proposed project of constructing a deck behind the house.

Public Hearing Open.

Mr. Jason Swift with Bay Design group stated that they're who prepared the plans in case the Board has any questions.

Public Hearing Closed.

Zoning Administrator Marston read the suggested conditions as follows: Suggested Conditions if Approved:

1. All required permits and/or licenses shall be obtained from all appropriate regulatory agencies.

Page 9

2. The deck addition shall be limited to a twelve (12) foot width and thirty two (32) foot length as shown on the revised site plan dated May 11, 2026.

3. Vegetative plantings shall be established within the Resource Protection Area on the first available planting season once the deck has completed construction to mitigate for the encroachment as shown on the revised site plan.

4. Four (4) inches of gravel shall be placed under the deck addition to collect stormwater as shown on the revised site plan.

5. Non-compliance of any of these conditions shall result in this permit to come back before the Board of Supervisors for possible revocation.

Supervisor Harris asked what vegetative plants are going to be established. Mr. Marston explained that the revised site plan calls for nine shrubs to be placed within 100 feet of the water along with 4 inches of gravel that will collect everything that runs through the decking boards.

Supervisor Fisher asked if there's a roof.

Mr. Marston stated that there is no roof proposed for this project.

Motion to approve the request by Darryl & Joyce Krolicki, owners, for an Exception to the Chesapeake Bay Preservation Area Ordinance to construct an addition to a dwelling on property zoned R-2, Residential Waterfront with the suggested conditions. This motion is made in due consideration of the administrative record before the body, including the planning commission’s deliberations and recommendation, the information received via the public hearing, including statements offered by staff, the applicant, and members of the public, the public health and safety, the general welfare of the community, public necessity, convenience, in the exercise of good zoning practices and the body’s legislative prerogative, and pursuant to the body’s statutory authority.

B. Request by Graydon Hester, owner, for a Conditional Use Permit to allow a multi-unit dwelling on property zoned R-1, Residential General. The property is shown as Tax Map Parcel # 36-(1)-31-A1 and is located at 731 Old Glebe Point Road. BOS_5_14_2026_ad_echo.pdf Hester-1.pdf Suggested ConditionsBOS-05-

2026.doc

Mr. Hester stated that the intention of the project is to house the employees working at Horn Harbor Restaurant. He explained that they built it as a single family house, but they constructed it with two kitchens, an upstairs and downstairs, so employees could be housed separately.

Supervisor Fisher asked why they don't utilize an already established residence on the restaurant property.

Page 10

Mr. Hester explained that they do have employees already living on the property, but they've found that working and living on the same property can be a bit much. Public Hearing Open

No comments were made.

Public Hearing Closed.

Zoning Administrator Marston read the suggested conditions as follows: Suggested Conditions if Approved:

1. All necessary permits and/or licenses shall be obtained from all appropriate regulatory agencies.

2. The construction of the multi-unit dwelling shall conform to the Uniform Statewide Building Code.

3. Any proposed lighting shall be shielded and directed downward to prevent any glare on adjoining properties or Old Glebe Point Road.

4. There shall be no on street parking and at least six (6) designated parking spaces.

5. This conditional use permit shall be revoked in the event that ownership changes from the Hester family.

6. Non-compliance of any of these conditions shall result in this permit to come back before the Board of Supervisors for possible revocation.

Mr. Marston explained that he spoke to the County Attorney regarding condition number 5 and he suggested removing this condition as it is not consistent with zoning practices.

County Attorney Gregory explained that zoning permits and changes typically run with the land, not the owner.

Chairman Brann asked how this project was presented to the County.

Mr. Marston stated that it was applied for as a single family dwelling and that's what the permits were issued for.

Chairman Brann asked what would have been done differently if it was applied for as a multi-family dwelling.

Mr. Marston stated that it would have been different zoning wise as it would have come to the Board before construction, but he doesn't want to speak to the building code as that is not his specialty.

Chairman Brann stated that he was disappointed that this got through the County because it clearly is not a single family dwelling. However, he said he's going to look at it as any other person in this County that's built apartments for renting.

Motion to approve the Conditional Use Permit to allow a multi-unit dwelling on property zoned R-1, Residential General with the suggested conditions, removing condition number 5 as it is not consistent with zoning practices. This motion is made in due consideration of the administrative record before the body, including the planning commission’s deliberations and recommendation, the information received via the public hearing, including statements offered by staff, the

applicant, and members of the public, the public health and safety, the general welfare of the community, public necessity, convenience, in the exercise of good zoning practices and the body’s legislative prerogative, and pursuant to the body’s statutory authority.

C. Request by Robert G. Bruechert, owner, for an Exception to the Chesapeake Bay Preservation Area Ordinance in order to construct an accessory structure on property zoned R-2, Residential Waterfront. The property is shown as Tax Map Parcel # 38-D(1)-17 and is located at 625 Harbor Drive.

BOS_5_14_2026_ad_echo.pdf Bruechert_Robert.pdf Suggested

ConditionsBOS 05-14-2026(3).doc

Mr. Bruechert presented his project to the Board as constructing an accessory structure on their property and unfortunately not having any other place to put it outside of the 100 foot resource protection area (RPA). He explained that they are proposing to build a dry well that is beyond the 100 foot RPA buffer so that any rainwater that strikes the roof, will go beyond the 100ft RPA.

Supervisor Harris asked if the land was suitable for a dry well.

Mr. Bruechert stated that the company who did the engineering calculations is the same company that did the topographical survey that was included in the application, so yes.

Public Hearing Open.

No comments were made.

Public Hearing Closed.

Zoning Administrator Marston read the suggested conditions as follows: Suggested Conditions if Approved:

1. All required permits and/or licenses shall be obtained from all appropriate regulatory agencies.

2. The accessory structure (30’ X 36’ pole barn) shall be constructed as shown on the site plan presented with the application.

3. Vegetative plantings shall be established within the Resource Protection Area on the first available planting season once the pole barn is completed construction to mitigate for the encroachment as shown on the site plan.

4. A Best Management Practice shall be constructed outside the Resource Protection Area to collect stormwater coming from the roof and allow for infiltration into the ground as designed and shown on the site plan.

Page 12

5. Non-compliance of any of these conditions shall result in this permit to come back before the Board of Supervisors for possible revocation.

Supervisor Fisher shared his concerns with approving the request as it would set a precedent in the County regarding the Bay Act.

Mr. Bruechert stated that the only reason they are here with the request is because they have no other alternative and he believes that is what the exception to the Chesapeake Bay Act is for.

Vice Chairman Williams asked how the water would get from the roof to the dry well.

Mr. Bruechert explained through a gutter system.

Supervisor Fisher asked Zoning Administrator Marston if a permit like this has ever been issued before.

Mr. Marston stated that since he's been with the County, there has not. Vice Chairman Williams asked Mr. Marston what distinguishes this from something he would allow.

Mr. Marston stated that permits have been issued for situations like this when it comes to redevelopment of existing structures and replacing with new, but not accessory structures.

The Board discussed tabling this matter to next month's meeting.

Vice Chairman Williams stated that he wanted to research more into dry wells.

Motion to table a decision to next month's regular meeting on June 11, 2026.
