Graydon Hester: allow a multi- unit dwelling (731 Old Glebe Point Road)

About the Board of Supervisors

In plain words

Graydon Hester, owner, asked for a Conditional Use Permit, a special permission, to allow a multi-unit dwelling at 731 Old Glebe Point Road, zoned R-1 (Residential General).1 The Planning Commission took up the request at a public hearing on April 16, 2026.2 Mr. Danny Hester, the father of the applicant, spoke and said he owns Horn Harbor Restaurant and built the home to house employees.2 At the hearing, the public made no comments, and the Zoning Administrator read six suggested conditions, including shielded lighting and at least six designated parking spaces.3 One condition would have revoked the permit if ownership changed from the Hester family, but the County Attorney explained that permits "run with the land, not the owner."3 On May 14, 2026, the Board of Supervisors voted 5-0 to approve the permit with the conditions, removing condition number 5.4

How a conditional use permit is decided

Some uses of land are allowed in a zoning district only with the Board of Supervisors' permission. An owner asks for that permission with a conditional use permit.

In Northumberland, the Planning Commission holds a public hearing on the request and makes a recommendation, then the Board of Supervisors holds its own public hearing and decides, often with conditions. Each hearing must be advertised in advance.

The law: Va. Code § 15.2-2286 (What a zoning ordinance may provide, including special exceptions and conditional uses); Va. Code § 15.2-2204 (Advertising public hearings). This describes the general process, not this decision.
