Finance Director Anne Curran provided an update to the Board related to recent activities within the Finance Department. The presentation can be accessed in the attachments.

Finance Facilitator Karen Pica explained the reasoning for changing the chart of accounts. Dr. Pica stated that that State annual report was due back in September 2025, and it just recently was submitted because every time Dr. Curran went to submit, it came back with several errors due to the State set of account codes not matching the County’s.

Dr. Pica then presented the budget proposal requested by the Board of

Supervisors that includes a 2% salary increase and the 4.5% health insurance adjustment. She stated that she eliminated the salary and benefits for the County Finance team as that is now included in the County’s budget. The proposal also includes the increased annual cost of Chesapeake Bay Governor’s school. Dr. Pica clarified that the nutrition budget is submitted separately as it does not require County funding.

Supervisor Harris asked if the Finance team has enough help and labor to do the account code changes.

Dr. Pica stated that they did, but Finance Director Anne Curran stated they could always use the help.

Page 4

Supervisor Fisher asked if Mrs. O’Bier is still on staff and asked how long they planned on keeping her to assist with the finances.

Dr. Curran stated they have her until May unless the budget allows us for more time with her.

Vice Chairman Williams asked about the SOQ bonus recommendation from the State.

Dr. Pica stated that would require 75% funding from the County and only 25% from the State due to the County’s local composite index.

Vice Chairman Williams asked if the School Division determines how many students will go the Governor's school and if the increase remains if the school sends the same amount of students.

Dr. Leslie confirmed that is correct.

Dr. Pica presented her request to the Board which is to dispose of and/or return $322,401 of prior year reimbursements. She explained that they can return the money to the County in full and place it in the General fund, place it in the school's capital improvement fund for the NES playground to be built over the summer, or split it between the school and the County. Dr. Pica stated that this does not need action taken tonight.

Chairman Brann asked Mr. Tadlock to put this on next month's agenda.

County Attorney Gregory read the following statement before the Board discussed the proposed conditional use permit for the cell tower.

"Please be advised that federal law and regulations pre-empt local regulation of radio frequency (“RF”) emissions and a local government is precluded from basing any decision concerning approval or disapproval of a cellular communications facility, directly or indirectly, in whole or in part or to any degree whatsoever, upon alleged or actual environmental effects of radio frequency (RF) emissions or public comments, discussion, or concerns regarding radio frequency (RF) emissions or radiation emissions.

Therefore, I caution against entertaining or considering comments, discussion, or concerns regarding RF emissions in this case.

Federal preemption concerning the regulation of RF emissions does not extend to local regulation of other issues such as construction, siting, permits, inspection, zoning, environmental review, and placement of antenna facilities within communities. Those issues may be addressed and regulated accordingly.

Thank you for your understanding and cooperation."

Zoning counsel for Vertical Bridge, Lisa Murphy, explained that they met with a majority of the Board to examine if the site could be placed further back from Movie Hall Lane and the adjourning property. Ms. Murphy stated that they were able to move it back 40 feet and address some of the concerns related to the structure and design of the tower. They proposed a condition that the tower will meet or exceed current minimum standards and regulations of all applicable federal, state, and local building codes and regulations and that the applicant will provide a full structural report stamped by an engineer when submitting a building permit application. Ms. Murphy stated that there was also a concern about the sound coming from the site if there is a generator, so they proposed another condition that if a generator is utilized at the site, sound from it will not exceed 70 dB when measured from any property line. She stated that there are updated zoning drawings in the Board's packet and the proffer presented last meeting still stands which can be found under the suggested conditions.

Page 13

Zoning Administrator Philip Marston read the suggested conditions as follows:

1. The construction of the tower shall be completed within twelve (12) months of the date of the building permit.

2. All sides of the tower shall be fenced with barbed wire.

3. The tower is to be constructed as depicted on the revised site plan dated 04/08/2026. The revised tower location is 40 feet further from Movie Hall Lane.

4. The proposed tower will meet or exceed current minimum standards and regulations of all applicable federal, state, and local building codes and regulations. The applicant will provide a full structural report stamped by an engineer when it submits a building permit application.

5. If a generator is utilized at the site, sound from it will not exceed 70 dB when measured from any property line.

6. Non-compliance of any of these conditions shall result in this permit to come back before the Board of Supervisors for possible revocation.

This approval comes with a proffer from The Towers LLC (d/b/a Vertical Bridge) authorizing the County to lease space on the Tower between the 140' and 150' level, together with a 10'x10' space on the ground within the compound, to accommodate the County’s public safety and emergency communications

equipment. Vertical Bridge will not require the County to pay rent; however, the County will be responsible for all construction and permitting costs. In addition, the County will execute Vertical Bridge’s standard form lease with a zero rental rate establishing the other terms and conditions of the County’s use of the Tower.

Motion to approve a Conditional Use Permit to construct a 195-foot

communications tower on property zoned B-1, Business General with the

suggested conditions. This motion is made in due consideration of the

administrative record before the body, including the planning commission’s deliberations and recommendation, the information received via the public hearing, including statements offered by staff, the applicant, and members of the public, the public health and safety, the general welfare of the community, public necessity, convenience, in the exercise of good zoning practices and the body’s legislative prerogative, and pursuant to the body’s statutory authority.

If the Board decides to include this suggestion from IT, he requested that the Board approve the additional question, authorize
