Spencer Headley, Chairman, called the meeting to order.

On a motion by Albert Fisher, seconded by George Rew, the agenda was approved.

On a motion by George Rew, seconded by Robert Vanlandingham, the minutes of the July 14, 2026 meeting were approved.

Application No. 26-1541

Coan Hall Farm, LLC – to install 104 linear feet of riprap revetment with a 16’ riprap spur and install 438 linear feet of riprap sill along the shoreline of the Coan River and 2387 Coan Wharf Road.

Craig Palubinski, agent for the owner, described the project. He noted that there are a lot of wooded areas with shade along the shoreline and water depths drop off quickly, therefore a living shoreline was not recommended.

After reviewing the project and there being no objections, Albert Fisher made a motion to approve the application as submitted for three years. Robert Vanlandingham seconded the motion and the Board unanimously approved.

Application No. 26-1445

David C. Harrison – to remove a damaged timber groin and construct a replacement low-profile timber groin 48 feet from MHW along the shoreline of Judith Sound and 279 Judith Sound Road. Craig Palubinski, agent, described the project and noted that the new groin would be set one foot inside the owner’s property line.

Walter H., IV and Jacquelyn N. Jones – to construct 65 linear feet of riprap revetment channelward of an existing deteriorated timber bulkhead along the shoreline of Bridge Creek and 728 Sweet Hall Drive.

Application No. 26-1484

Gary and Laura Lewis – to install 289 linear feet of riprap revetment along the shoreline of Glebe Creek and 1246 Coan Harbor Drive.

Joseph Scott, agent for the owner, described the project. He noted that due to the canopy cover, the site north facing and the water drop off, a living shoreline was not recommended. After reviewing the project and there being no objections, Robert Vanlandingham made a motion to approve the application as submitted for three years. Albert Fisher seconded the motion and the Board unanimously approved.

Application No. 26-1485

Eileen Tullner – to repair 225 linear feet of existing riprap revetment and install 25 linear feet of riprap revetment along the shoreline of Prentice Creek and 2054 Ditchley Road.

Joseph Scott, agent for the owner, described the project. He noted that there is a 26-mile fetch from the SE. He also noted that the 25 feet of riprap revetment would be behind any wetland vegetation.

After reviewing the project and there being no objections, Robert Vanlandingham made a motion to approve the application as submitted for three years. George Rew seconded the motion and the Board unanimously approved.

Application No. 26-1463

Joseph Scott, agent for the owner, described the project. He noted that a living shoreline was not considered because the banks had eroded up to 4 and 5 feet high. He said that in order to stabilize it there would be a lot of trees removed and the banks graded.

After reviewing the project and there being no objections, Albert Fisher made a motion to approve the application as submitted for three years. George Rew seconded the motion and the Board unanimously approved.

Other Business

The Board reviewed the revised plans submitted by Scott B. Johnson (V.M.R.C. 26-0802). After the Board reviewed the revised drawing, Albert Fisher made a motion to approve the project for three years as shown on revised drawings dated August 6, 2026. George Rew seconded the motion and the Board unanimously approved.

Chairman Headley asked about an update on the Ramos property located on Fleeton Road. Philip Marston stated that the Board of Supervisors denied Mr. Ramos’ request for an After-The-Fact Exception to the Bay Act for the structure that was built near the water. “I have been working with him to get that building torn down. I will follow up with Mr. Ramos as to what he needs to do in order to correct this wetlands violation.” Mr. Marston asked for guidance with a show cause hearing. Jeff Madden stated that unless Mr. Ramos would like to voluntarily restore the area, the Board, or staff, needs to let him know 30 days in advance for a show cause hearing. He also noted that he could ask for input from VIMS to help determine what needs to be done to solve the problem. Philip Marston explained the difficulty he has had in communicating with Mr. Ramos. Jeff Madden suggested other methods of getting notifications to Mr. Ramos.

Chairman Headley stated that he wanted to see Mr. Ramos in front of the Board to answer some of the questions that the Board is asking.

There being no further business to come before the Board, on a motion by Robert Vanlandingham seconded by George Rew, the Board unanimously voted to adjourn.
